Decision

Ottawa, 22 January 1991
Decision CRTC 91-59
Power Broadcasting Inc.
Prescott, Ontario - 900897000
Following a Public Hearing in the National Capital Region beginning on 27 November 1990, the Commission approves the application by Power Broadcasting Inc. (Power) for a licence for an English-language television broadcasting transmitting undertaking at Prescott, on channel 26 with an effective radiated power of 5,100 watts to rebroadcast some of the programs of CKWS-TV Kingston, Ontario, received over-the-air. The applicant has also indicated that it will broadcast locally-produced news and information programming from a studio which it proposes to operate at Brockville, Ontario.
The Commission will issue a licence expiring 31 August 1994, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to consider renewal of this licence at the same time as that of CKWS-TV.
The Department of Communications has advised that the undertaking will use channel 26 rather than channel 45 as indicated in CRTC Notice of Public Hearing 1990-13 dated 28 September 1990. Power did not implement the authority granted in Decision CRTC 89-841 to Frontenac Broadcasting Company Limited, the previous licensee of CKWS-TV, which would have allowed the station's coverage to extend to the northeast in the direction of Brockville. As an alternate method, Power decided to submit this application to enable it to "reacquire its historical cable priority status and permit a new opportunity for local programming to the region".
It is a condition of licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
The Commission acknowledges the intervention by Henry Lewis regarding this application.

Secretary General
