Pursuant to Public Notice CRTC 1991-32 dated 22 March 1991, the Commission approves the application by MusiquePlus Inc. (MusiquePlus) to amend its conditions of licence Nos. 4 and 14 regarding the definition of "broadcast week" as defined in section 2 of the Radio Regulations, 1986, SOR/86-982, as amended, and "broadcast day", as set out in section 2 of the Television Broadcasting Regulations, 1987, SOR 87/49, as amended.
Accordingly, conditions of licence Nos. 4 and 14 have been amended as follows:
4. "broadcast week" means seven consecutive broadcast days beginning on a Friday".
14. "broadcast day" means a 24 hour period beginning at 00:00:01 hour.
In approving this application, the Commission has taken into consideration MusiquePlus' arguments that under the current definition of "broadcast week", it must prepare its playlist five days before new releases are ready for distribution.
The licensee further claimed that approval of this application will better enable it to achieve its required levels of Canadian content as well as French-language selections and to distribute new material as soon as possible. The Commission notes that under the new definition of "broadcast day", MusiquePlus' minimum Canadian content requirement will increase by 3 hours 37 minutes (from 60% of 18 hours to 60% of 24 hours).
The Commission also notes that the fact that the amendments relate to the particular circumstances of a music specialty service was taken into account in deciding to approve this application.
