Following a Public Hearing in Quebec City beginning on 5 March 1991, the Commission renews the licence for the broadcasting receiving undertaking serving the communities noted above, held by Sirois Câble Inc., from 1 September 1991 to 31 August 1994. This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.
The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute CFJP-TV Montréal, received via satellite, as part of the basic service. In Decision CRTC 89-284 dated 23 May 1989, the Commission approuved, by condition of licence, the licensee's request to distribute the complete programming service of CFTM-TV Montréal, received via satellite from the CANCOM network, in view of the unacceptable signal quality of CHAU-TV-5 Percé, received at Chandler. On 8 May 1991, the Department of Communications confirmed that, as a result of the microwave link established between Mont St-Joseph at Carleton and Mont Blanc at Percé by Télévision de la Baie des Chaleurs Inc. licensee of CHAU-TV, the reception quality of that signal at Chandler is now excellent. The licensee must therefore delete duplicate programming or substitute the local TVA service when the programming is identical.
Consistent with Decision CRTC 87-520 dated 23 June 1987, it is a condition of licence that the licensee be relieved of the requirement of section 23 of the regulations that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service.
The Department of Communications has advised the Commission that it is prepared to renew the Broadcasting Certificate for a period of two years only, expiring 31 August 1993. With respect to the operation of this undertaking beyond this period, the Commission draws the licensee's attention to paragraph 13(1)(b) of the Broadcasting Act pertaining to the technical certification of broadcasting undertakings and to subsection 13(2) which provides that any broadcasting licence issued, amended or renewed in contravention of section 13 is of no force or effect.
