Pursuant to Public Notice CRTC 1987-75 dated 16 March 1987, the Commission renews the licence for the broadcasting receiving undertaking serving the communities noted above and will issue a licence to Sirois Cable Inc. from 1 October 1987 to 31 August 1991. The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, without advertising material, the special programming service consisting of pay television promotional material.
The Commission notes that the licensee proposes to continue distributing the pay television service Premier Choix: TVEC Inc., received via satellite, as well as one Canadian and one U.S. CANCOM television service. The Commission has taken into account the particular circumstances of this undertaking, namely the amount and variety of Canadian services currently distributed, and the linguistic profile of the communities which are predominantly French-speaking, and it relieves the licensee, by condition of licence, from the application of section 23 of the regulations. Section 23 stipulates that a Part III licensee wishing to distribute any Part III eligible non-Canadian satellite, pay television or specialty service delivered by satellite must also distribute "at least four television programming services delivered to its local head-end by a network operator licensed to extend television and radio to remote and underserved communities, at least one of which must be a Canadian programming service".
The Commission received an intervention from the Corporation municipale de Newport regarding the provision of cable service to the unserved portions of the licensed area, in particular the western boundary of the municipality of Newport. The Commission has taken note of the licensee's reply to the effect that construction of the area noted above was to have taken place in April 1987.
