Pursuant to Public Notice CRTC 1989-129 dated 22 November 1989, the Commission approves the application to amend the licence of the broadcasting receiving undertaking serving parts of Montreal and Laval by deleting the distribution of WMTW-TV (ABC) Poland Spring, Maine, and continuing, by condition of licence, to relieve the licensee of the requirement under subparagraph 10(1)(g)(i) of the Cable Television Regulations, 1986, which will allow it to add, at its option, the distribution of WCFE-TV (PBS) Plattsburgh, New York.
The Commission notes that at the last renewal of this licence (Decision CRTC 86-974), it authorized the licensee to continue distributing the signals of two affiliates of the same American network received over-the-air at its local head end. That decision was based on the particular circumstances in this case, including the fact that the situation has existed for several years. It notes that this authorization to add a second PBS network signal received over-the-air, on condition that one ABC signal be deleted, will not represent an increase in the number of non-Canadian signals distributed by this undertaking.
The licensee stated that by deleting the WMTW-TV station and adding the WCFE-TV station, the reception quality of the signal will be greatly improved. In addition, the differences between the programming schedules of the two PBS stations to be distributed are more significant than the differences between the two ABC station schedules, especially during the evening and weekend, thus adding diversity. The licensee also indicated that a survey of its subscribers indicated a majority are in favour of the proposed change.
The Commission notes that 19 interventions were received in connection with this application, all but one of which were in support. The Commission considered all of these, and particularly the opposing intervention filed by the Agency for Tele-Education in Canada, as well as the licensee's reply.
