Following a Public Hearing in the National Capital Region on 26 July 1988, the Commission approves the application by 2545-3739 Québec Inc. for a licence to carry on a broadcasting receiving undertaking to serve Percé, Cap-d'Espoir and Anse-à-Beaufils. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).

The Commission will issue a licence expiring 31 August 1993, subject to the conditions specified in this decision and in the licence to be issued.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute, at its option, CFJP-TV Montreal.

The Commission approves the applicant's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the applicant not be required to distribute at least four television programming services delivered to its local head-end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service.

In approving this proposal, the Commission has taken into account the applicant's arguments including that the system will be located in an area where the number of potential subscribers is limited and that virtually all of its subscribers will be francophone. The Commission notes that one French-language Canadian television service and two U.S. television services, received via satellite from the CANCOM network will be distributed, namely TCTV Montreal, WJBK-TV (CBS) and WDIV (NBC) Detroit, Michigan. It also notes that the applicant will distribute the CBC, SRTQ, TVA and TQS French-language network services.

The applicant has applied to distribute French Television Programming (TVFQ-99) and the special programming service Enfants-Jeunesse (Télé des Jeunes). The Commission notes, however, that these services are no longer available.

With respect to the intervention received from Télévision de la Baie des Chaleurs Inc., licensee of CHAU-TV-5 Percé, the Commission wishes to point out that, as stipulated in Public Notice CRTC 1986-183 on Eligible Canadian Satellite Services, the applicant is authorized to distribute TCTV, subject to the requirement that it delete the duplicate programming from TCTV or substitute the local signal of CHAU-TV-5 when identical programming is broadcast.

It is a condition of licence that the authority granted herein be implemented within twelve months of the date of this decision or, where the applicant applies to the Commission and satisfies the Commission that it cannot implement its authority before the expiry of this twelve-month period and that an extension of this period is in the public interest, within such further period of time as is approved in writing by the Commission.
