Decision CRTC 85-214
Short-term Licence Renewal of the CTV Television Network, and of Individual Television Stations at Various Locations Across Canada, Expiring 30 September 1985
The Commission, by majority decision, renews the network licence issued to CTV Television Network Ltd., and the broadcasting licences for the television stations listed in the appendix to this decision from 1 October 1985 to 30 September 1987, subject to the terms and conditions of the current licences.
As noted in Public Notice CRTC 1985-79 of today's date, the government's recently-announced Canadian broadcasting policy review will include an examination of the role and mandate of the public and private sectors of the Canadian broadcasting system and their inter-relationships.
In light of the above, the Commission has decided that the public interest would best be served if public hearings on the renewals of these licences were not held until the government's Task Force recommendations are known.
This will permit the licensees to submit applications taking into account the implications of such recommendations, and will allow the Commission to assess the licensees' proposed overall long-term plans, particularly their programming plans.
Notwithstanding the above, the Commission requires the CTV Television Network Ltd., and the licensees of the originating private television stations listed in the appendix to this decision, to submit reports on their Canadian content programming plans and commitments, priorities, scheduling practices, program sources and budgetary allocations for the 1985/86 and 1986/87 broadcasting seasons.
These reports should be filed before 30 May 1985 and 30 May 1986 respectively and will be examined by the Commission and placed on the public file. The Commission will then determine in each case whether any further proceedings are necessary.
As noted in Public Notice CRTC 1985-79, the Commission will continue to carry out its regulatory and supervisory activities.
The Commission draws the licensees' attention to its January 1983 Policy Statement on Canadian Content in Television which focuses on the need to develop a wide rate of Canadian programming of competitive quality for scheduling at popular viewing hours. The Commission reaffirms this objective and expects the licensees to make every effort in this regard.
In this context, the Commission reiterates the expectations expressed in Decision CRTC 81-460 renewing the licences of the CBC, CTV and TVA network services, and further expects the licensees:
 to respond creatively and imaginatively to Parliament's desire, as expressed in the Broadcasting Act, that Canadians in all parts of the country receive adequate service and that such service respond to the special needs of geographic regions, "actively contributing to the flow and exchange of cultural and regional information and entertainment" and that the "programming provided by each broadcaster should be of high standard, using predominantly Canadian creative and other resources."
Minority Opinion
Commissioner Monique Coupal dissented from the proposed two year renewal of the CTV television network and other stations outlined in the appendix to this decision on the following grounds:
 Under the Broadcasting Act, the Commission is obliged to hold a public hearing for the renewal of a broadcasting licence in order to review the performance of a licensee. Notwithstanding the government's Task Force to review the broadcasting policy, it is still the legal obligation and responsibility of the Commission to supervise and regulate the Canadian broadcasting system, and it should continue to do so in all areas of its activities.
 The Commission is failing to live up to its duties by granting an automatic licence renewal of two years to private commercial licensees.
