Description: Canadian Network Operators Consortium Inc. (“CNOC”) has recently become aware that in updating their tariffs to reflect the Commission’s determinations in Telecom Regulatory Policy CRTC 2015-326 (“TRP 2015-326”) a number of ILECs have frozen their dry loop rates without proper regulatory authority. This situation has arisen because TRP 2015-326 froze the rates for unbundled local loops and most of the ILECs base their dry loop rates on a percentage of their unbundled local loop rates, thus when the unbundled local loop rates are frozen, the dry loop rates also become frozen. However, there was no regulatory authority in TRP 2015-326 for the freezing of dry loop rates.
