Objet : Tarifs des ESLC applicables à l'interconnexion
Dans la Décision de télécom CRTC 2006-35 du 29 mai 2006 intitulée Suivi de la décision Arrangements de circuits régissant l'échange de trafic et le point d'interconnexion entre les entreprises de services locaux, Décision de télécom CRTC 2004-46 (la décision 2006-35), le Conseil a approuvé les définitions modifiées des régions d'interconnexion locale (RIL) proposées par chaque entreprise de services locaux titulaire (ESLT). De plus, le Conseil a approuvé de manière définitive les tarifs d'interconnexion applicables au raccordement du trafic des entreprises de services locaux concurrentes (ESLC) à l'intérieur des RIL pour chaque ESLT. Le Conseil a également modifié la structure tarifaire de manière à inclure des tranches de 10 p. 100 pour le déséquilibre du trafic. Le Conseil a alors déterminé que ces taux prendraient effet à compter de la date de la décision 2006-35, soit le 29 mai 2006.
À cet égard, le personnel du Conseil note que dans la Décision de télécom CRTC 2002-34 du 30 mai 2002 intitulée Cadre de réglementation applicable à la deuxième période de plafonnement des prix , le Conseil a ordonné à chaque ESLT de publier, au plus tard le 1 er juin de chaque année, des pages de tarifs incluant des rajustements aux tarifs des Services des concurrents de catégorie 1 pour tenir compte de l'application d'une restriction équivalant au taux d'inflation moins un facteur de productivité (la restriction I-X). Conformément à cette décision, les ESLT ont publié des pages de tarifs, entrant en vigueur le 1 er juin 2006, et réduisant les taux applicables au raccordement du trafic des ESLC à l'intérieur des RIL.
Dans la Décision de télécom CRTC 2006-48 du 3 août 2006 intitulée MTS Allstream et Bell Canada - Demandes en vertu de la partie VII concernant le service 900 , le Conseil a déterminé que les garanties destinées aux consommateurs à l'égard du service 900 devraient être d'application générale et viser tous les fournisseurs de services 900 et fournisseurs de contenu 900, ainsi que toutes les relations entre les fournisseurs de contenu 900, les fournisseurs de services 900, les entreprises de services locaux et les bureaux centraux liés au service 900. Par conséquent, le Conseil a déterminé que le modèle tarifaire des ESLC devraient être modifié afin d'inclure explicitement les mêmes garanties destinées aux consommateurs à l'égard du service 900 que celles que le Conseil a déjà imposées aux grandes ESLT.
Dans la Décision de télécom CRTC 97-8 du 1 er mai 1997 intitulée Concurrence locale , le Conseil a examiné s'il était dans l'intérêt public d'exiger que les ESLC fournissent l'interconnexion dans le cas des fournisseurs de services sans fil et l'égalité d'accès dans le cas de tous les fournisseurs de services intercirconscriptions, selon des modalités et des conditions équivalentes à celles contenues dans les tarifs des ESLT. Le Conseil a exigé que les ESLC déposent les tarifs proposés pour l'interconnexion et qu'elles justifient toute dérogation aux modalités et aux conditions contenues dans les tarifs des ESLT.
Dans la Décision de télécom CRTC 2002-43 du 31 juillet 2002 intitulée Mise en oeuvre de la réglementation des prix pour Télébec et TELUS Québec , le Conseil a ordonné à Société en commandite Télébec (Télébec) et à TELUS Communications (Québec) (TCQ) de publier, au plus tard le 1 er août de chaque année, des pages de tarifs incluant des rajustements aux tarifs des Services des concurrents de catégorie 1 pour tenir compte de l'application de la restriction I-X.
Dans la Décision de télécom CRTC 2006-9 du 16 février 2006 intitulée Utilisation des fonds des comptes de report , le Conseil a ordonné à Télébec de suspendre l'application de la restriction I-X à l'égard de ses ensembles Services des concurrents et Autres services plafonnés à compter du 1 er août 2006, afin de minimiser le manque à gagner récurrent de son compte de report.
Conformément à ces décisions, TCQ a publié des pages de tarifs, entrant en vigueur le 1 er août 2006, et réduisant ses tarifs pour les Services des concurrents.
Par conséquent, les ESLC doivent déposer dans les 30 jours suivant la réception de cette lettre les tarifs qu'elles proposent à compter des dates susmentionnées et qui correspondent aux tarifs des ESLT applicables à l'interconnexion, ou ceux qu'elles proposent avec justification à l'appui de tout écart par rapport auxdits tarifs des ESLT. Pour aider les ESLC à remplir leurs demandes, veuillez prendre note que les nouveaux tarifs provinciaux applicables à l'interconnexion figurent sur le site Web du CRTC, à la version 27 du modèle tarifaire des ESLC.
De plus, les ESLC doivent évaluer les conditions des remises à partir des dates d'entrée en vigueur indiquées précédemment, en calculant l'écart entre les tarifs approuvés de façon définitive par le Conseil et les tarifs chargés aux abonnés au cours de chaque année de plafonnement des prix, et verser ces remises aux abonnés. Pour aider les ESLC avec ce processus, des tableaux indiquant les tarifs applicables sont joints à la présente lettre.
