Subject: Consumer Protection Codes harmonization proceeding
Dear Émile Arsalane:
As you know, the submission deadlines associated with your Part 1 application were suspended on 3 February 2026. This suspension has allowed the Commission to carefully consider the issues raised in your application and the procedural requests submitted in this proceeding. A Commission determination addressing these procedural requests and the next steps in the proceeding will be communicated in due course.
In the meantime, Commission staff would like to ensure that you are aware of the Consumer Protection Codes harmonization proceeding (BTNOC 2026-134). Since your application raises issues concerning modifications to the Wireless Code, you may wish to submit comments on the record of BTNOC 2026-134, which is open for comments until 11 August 2026 which will have a public hearing component starting on 30 November 2026.
The Notice of Consultation for this proceeding is available here: https://crtc.gc.ca/eng/archive/2026/2026-134.htm. Instructions on how to participate in BTNOC 2026-134 are set out in paragraphs 19 to 41.
As your application raised issues related to activation fees and fees for back copies of bills, staff would like to call your attention to the following:
- Telecom Regulatory Policy 2026-43 prohibits telecommunications service providers from charging certain activation and modification fees, and
- Telecom Decision 2020-80 clarified that clarifies that wireless service providers may charge a fee for the reissuance of bills outside the current billing cycle (i.e. for reprints of past bills).
Further, staff would like to note that the following issues raised in your application would likely be considered out of scope of BTNOC 2026-134:
- whether business practices involving Plaid or similar services infringe upon customers’ privacy and
- relief under section 27(1) of the Telecommunications Act concerning just and reasonable rates.
More information on the scope of BTNOC 2026-134 is set out in paragraphs 16 to 18 of the Notice of Consultation.
