Subject: Procedural letter - TELUS Tariff Notice 607 – New Speed for Network-to-Network Interface Services - Staff ruling on disclosure requests of certain information filed in confidence
This letter addresses requests for disclosure of information filed in confidence in the above-noted proceeding by TekSavvy.
On 15 October 2025, TELUS Communications Inc. (TELUS) filed Tariff Notice 607, proposing the introduction of a new speed for its Network-to-Network Interface service in Alberta and British Columbia. In support of its application, TELUS filed cost studies that included high-level costing information. In a letter dated 19 March 2026, Commission staff issued requests for information (RFIs) seeking further details, including a breakdown, by sub-activity, of the identified Major Functions identified in “Table 6a – Expenses”.
TekSavvy submitted that, at a minimum, TELUS should be required to file abridged versions of its responses to RFI #2 and RFI #4 in accordance with Broadcasting and Telecom Information Bulletin 2010-961. TekSavvy argued that information that is not inherently sensitive, such as headings, tables of contents, and text that does not itself reveal confidential information, should remain on the public record.
TELUS claims that its responses contain extensive and intricate details regarding the company’s business processes and internal systems and that disclosing them would prejudice TELUS’ competitive position by allowing competitors to estimate how TELUS plans its workflow and manages its finances and personnel. TELUS further submitted that the structure and headings of the responses themselves reveal the design and sequence of its internal processes and that filing abridged versions containing only headings or limited text would nonetheless disclose commercially sensitive information.
Commission staff notes that requests for disclosure of information designated as confidential are addressed in light of sections 38 and 39 of the Telecommunications Act (the Act) and section 30 and following of the CRTC Rules of Practice and Procedure (the Rules of Procedure). In evaluating a request, an assessment is made as to whether the information falls into a category of information that can be designated as confidential pursuant to section 39 of the Act. An assessment is then made as to whether there is any specific direct harm likely to result from the disclosure of the information in question and whether any such harm outweighs the public interest in disclosure. In making this evaluation, a number of factors are taken into consideration, including the degree of competition and the importance of disclosure of the information for the purpose of obtaining a more fulsome record. The factors considered are discussed in more detail in Procedures for filing confidential information and requesting its disclosure in Commission proceedings, Broadcasting and Telecom Information Bulletin CRTC 2010-961, 23 December 2010, as amended by Broadcasting and Telecom Information Bulletin CRTC 2010-961-1, 26 October 2012.
Commission staff has reviewed the requests filed by TekSavvy, as well as reply comments from TELUS. In line with the Commission’s Rules of Procedure and the Information Bulletin 2010-961, TELUS is directed to file abridged versions of their responses to RFIs #2 and #4, and disclose information that is not sensitive for the purposes of sections 39(1)(a), (b) and subparagraph (c)(iii) of the Act. TELUS is also directed to disclose the table and column headings, introductory paragraphs, and the explanatory paragraphs that follow the tables provided in response to RFI questions 2a and 4a, provided such content does not directly reference confidential sub-activities.
Disclosure
Commission staff sets out the following process to address disclosure.
TELUS is to disclose the information specified in this letter by 31 July 2026.
The information is to be filed with the Commission and served to all parties in the attached distribution list.
Any party may submit comments with respect to the additional information directed to be disclosed by 7 August 2026. TELUS may reply to any such comments by no later than 14 August 2026.
