Dear Fabien Fourmanoit, Dragos Vacar, and Distribution List organizations,
The Canadian Radio-Television and Telecommunications Commission (CRTC) is an administrative tribunal responsible for the administration of Telecommunications Act (the Act), including policies that encourage competition in markets to ensure that Canadians have a choice of telecommunications service provider (TSP).
The Commission is currently considering the above-referenced Part 1 application, filed by Beanfield Technologies Inc. (Beanfield). In its application, Beanfield is requesting access to the MDU at 50 Charles Street East, Toronto, Ontario administered by Toronto Standard Condominium Corporation No. 2662 (TSCC 2662) to install its fibre-based facilities and provide telecommunications services.
Section 37 of the Act provides that the Commission may require Canadian carriers or any person to file information or documents that the Commission considers necessary for the administration of that Act. As part of its consideration of Beanfield’s above-noted application, the Commission is sending this request for information (RFI) to gather information about TSP equipment installed and services being provided to the tenants at the MDUs.
All recipients of this RFI are requested to provide a response to the attached questions by
10 August 2026. In addition to filing their response with the Commission, the respondents must also serve a copy of their responses on Beanfield and TSCC 2662.
Recipients are also reminded that their responses are required to be submitted electronically, and in full compliance with the applicable provisions of the CRTC Rules of Practice and Procedure. Your responses will become part of the public record and will be posted on the CRTC website.
Section 39 of the Telecommunications Act and Broadcasting and Telecom Information Bulletin CRTC 2010-961 provide that persons may designate certain information is confidential and why its disclosure would not be in the public interest must be provided, including why the specific direct harm that would likely to result from the disclosure would outweigh the public interest in its disclosure.
If you file a document containing confidential information, an abridged version of the document omitting only the confidential information must also be filled with the Commission. Alternatively, reasons why an abridged version cannot be filed must be provided. Only the abridged version of the document will become part of the public record and will be posted on the CRTC website.

Questions for Distribution List organizations:
- Confirm whether you have any telecommunications equipment, including copper wire and fibre-based equipment, installed at the above-referenced MDU.
- Provide a copy of all agreements concluded with TSCC 2662 or any other entity which provide access to the above-referenced MDU for the purpose of installing equipment and providing telecommunications services to residents/customers.
- Provide the total number of customers in the above-referenced MDU to whom you currently provide telecommunications services.
- Confirm whether you are aware of any other TSPs serving tenants or who have telecommunications facilities installed at the MDU. If applicable, provide the name of the service provider(s).
- In its application, Beanfield requested that the Commission enforce the MDU access condition pursuant to section 24 of the Telecommunications Act, as follows:
- Effective 30 days from the date of this decision, no other LEC nor carrier ISP will be permitted to provide services to any new customer, regardless of whether the customer is a new or current resident.
- Effective 45 days from the date of the Commission’s decision, no LEC nor carrier ISP will be permitted to modify or upgrade the services being provided to a current resident and customer.
- If access is not granted within 60 days from the date of the Commission’s decision, the Commission will explore all regulatory options available to it, including issuing an order under Section 42 of the Act and issuing a decision which could result in all LECs and carrier ISPs present in the Property not being permitted to provide any services to the residents.
In the event that the Commission finds that Beanfield is being denied non-discriminatory and timely access to the above-referenced MDU, comment on the possibility that the Commission may impose the relief requested by Beanfield.
Question for Beanfield and TSCC 2662:
- Provide a complete update on the negotiations between Beanfield and TSCC 2662 regarding an access agreement to the above-referenced MDU.
