Dear Joe Power, representatives of City Centre Property Management and Boston Developments, and Marielle Wilson,
The Canadian Radio-Television and Telecommunications Commission (CRTC) is an administrative tribunal responsible for the administration of the Telecommunications Act (the Act), including policies that encourage competition in markets to ensure that Canadians have a choice of telecommunications service provider (TSP).
The Commission is presently considering the above-referenced Part 1 application, filed by Purple Cow Internet Inc. (Purple Cow). In this application, Purple Cow is requesting access to an MDU located at 5 Williams St., Dartmouth, Nova Scotia owned and operated by City Centre Property Management and Boston Developments (CCPM & BD) to install its fibre-based facilities and provide telecommunications services.
Section 37 of the Act provides that the Commission may require Canadian carriers or any person to file information or documents that the Commission considers necessary for the administration of that Act. As part of its consideration of Purple Cow’s above-noted application, the Commission is sending this request for information (RFI) to gather information about TSP equipment installed and services being provided to the tenants at the MDU.
All recipients of this RFI are requested to provide a response to the attached questions by 10 August 2026. In addition to filing their response with the Commission, the respondents must also serve a copy of their response on Purple Cow Internet Inc. and City Centre Property Management and Boston Developments.
Recipients are also reminded that their responses are required to be submitted electronically, and in full compliance with the applicable provisions of the CRTC Rules of Practice and Procedure. Your responses will become part of the public record and will be posted on the CRTC website.
Section 39 of the Act and Broadcasting and Telecom Information Bulletin CRTC 2010-961 provide that persons may designate certain information submitted to the Commission as confidential. A detailed explanation of why the designated information is confidential and why its disclosure would not be in the public interest must be provided, including why the specific direct harm that would be likely to result from the disclosure would outweigh the public interest in its disclosure.
If you file a document containing confidential information, an abridged version of the document omitting only the confidential information must also be filed with the Commission; alternatively, reasons why an abridged version cannot be filed must be provided. Only the abridged version of the document will become part of the public record and will be posted on the CRTC website.

Questions for Bragg Communications Inc., operating as Eastlink:
- Confirm whether you have any telecommunications equipment, including copper wire, fibre-based and wireless equipment, installed at the above-referenced MDU.
- Provide a copy of all access agreements concluded with CCPM & BD or any other entity which provide access to the above-referenced MDU for the purpose of installing equipment and providing telecommunications services to residents/customers.
- Provide the total number of customers in the above-referenced MDU to whom you currently provide telecommunications services.
- Confirm whether you are aware of any other TSPs serving tenants or who have telecommunications facilities installed in the MDU. If applicable, provide the name of the service provider(s).

In its application, Purple Cow requests that the Commission enforce the MDU access condition pursuant to section 24 of the Telecommunications Act, as follows:
- Effective 15 days from the date of the Commission’s decision, no other LEC nor carrier ISP will be permitted to provide services to any new customer, regardless of whether the customer is a new or current resident.
- Effective 30 days from the date of the Commission’s decision, no LEC nor carrier ISP will be permitted to modify or upgrade the services being provided to a current resident and customer.
- If access is not granted within 45 days from the date of the Commission’s decision, the Commission will explore all regulatory options available to it, including issuing an order under Section 42 of the Act and issuing a decision which could result in all LECs and carrier ISPs present in the Property not being permitted to provide any services to the residents.
In the event that the Commission finds that Purple Cow is being denied non-discriminatory and timely access to the above-referenced MDU, comment on the possibility that the Commission may impose the relief requested by Purple Cow.
Questions for Purple Cow and CCPM & BD:
- Provide a complete update on the negotiations between Purple Cow and CCPM & BD regarding an access agreement to the above-referenced MDU.
