Cost recovery charges (Online News Act)
- The Online News Act (the Act) applies to the operators of the largest online platforms that make news content available in Canada. Under the Act, the Commission can make regulations that allow it to recover the costs of its regulatory work from these operators.
- Subsection 4(1) of the Cost Recovery (Online News Act) RegulationsFootnote 1 (the Regulations) provides for the payment of an annual cost recovery charge by any applicable operator.
- Under section 5 of the Regulations, the Commission must publish a notice setting out the estimated costs to be incurred in a fiscal year that are attributable to the Commission exercising its powers and carrying out its duties and functions under the Act. For the 2026-2027 fiscal year (1 April 2026 to 31 March 2027), this amount is $2.708 million.
- The Regulations provide for an annual adjustment to ensure that only the Commission’s actual costs are recovered. In accordance with subsection 4(3) of the Regulations, a downward annual adjustment of $0.405 million has been calculated for the 2025-2026 fiscal year. This amount has been credited in the current fiscal year.
- As such, the net billing for the Commission’s cost recovery charge for the 2026-2027 fiscal year is $2.303 million. This represents a decrease of 15.3%Footnote 2 compared to the net billing amount for the 2025-2026 fiscal year ($2.719 million).
