Subject: Procedural Request – Rogers Tariff Notice (TN) 86 – New Service Speed Introductions for Third Party Internet Access (TPIA) – TekSavvy request for expedited interim relief

On 15 July 2025, the Commission received an application from Rogers Communications Canada Inc. (Rogers) proposing changes to its Access Services Tariff 21530, New Service Speed Introductions for Third Party Internet Access.

On 16 July 2025, the Commission received a procedural request from TekSavvy Solutions Inc. (TekSavvy) requesting expedited interim relief in the form of immediate approval of at least the 300 Mbps Download / 30 Mbps Upload speed in the Rogers East serving territory, if not all of the new speeds, included in Rogers TN 86.

TekSavvy further noted that TN 86 both requests approval of the introduction of new service speeds and requests approval of the destandardization of certain service speeds, which simultaneously engages two different sets of deadlines for interventions (30 days for tariff applications introducing and changing existing services, and 45 days for destandardization of tariffed services) and that this would complicate participation for interested parties. TekSavvy requested that the Commission either require Rogers to divide TN 86 into two applications, one to add new services and another to destandardize services, or for the Commission to treat the two issues separately within the process of one tariff application, with two different filing deadlines for interventions.

Rogers filed a response to TekSavvy’s procedural request on 21 July 2025. Rogers suggested a 45-day comment period for all aspects of its tariff application, arguing that extending the timeline from 30 days to 45 would not materially affect outcomes. However, Rogers noted that the company was amenable to a 30-day response period. Rogers emphasized that requests for new speed tiers and the destandardization of existing ones must be addressed together to uphold speed-matching obligations and avoid increasing the cost and complexity of wholesale services.

Process

In staff’s view, the most efficient means of addressing TN 86 is to treat the introduction of the new service speeds and the destandardization as two separate issues within a single process under a single deadline, rather than returning the application to Rogers and directing the company to file separate TNs, since this would potentially delay the introduction of the new service speeds.

As such the deadline for any party to submit comments for both the introduction of new speeds and the destandarization of current speeds, will be 29 August 2025, 45 calendar days from the filing date. Rogers may reply to any such comments by no later than 08 September 2025, as per the guidelines for competitor tariff applications outlined in Telecom Information Bulletin CRTC 2010-455-1.

Procedure for tariff applications for wholesale high-speed access services

As stated in Telecom Information Bulletin CRTC 2010-455-1, the deadline for comments on tariff applications that do not belong to Group A, such as the introduction of new service speeds for wholesale high-speed access (HSA) services, is 30 calendar days from the filing date, and comments on applications for destandardization and/or withdrawal of tariffed services is 45 calendar days from the filing date. As such, all parties are reminded that, for wholesale HSA services, tariff applications for the introduction of new service speeds and requests for destandardization should be made in separate tariff applications as they have different intervention periods.
