Subject: Request for Information – Part 1 Application by Bell Canada opposed to 1000283696 Ontario Inc. and Mauser Property Management for access to 203 Mausser Avenue, Kitchener, Ontario
Dear Peter Kovacs,
The Canadian Radio-Television and Telecommunications Commission (Commission) is currently considering the above referenced Part 1 application, filed by Bell Canada (Bell). In its application, Bell is requesting access to the multi-dwelling unit (MDU) located at 203 Mausser Avenue, Kitchener, Ontario. The MDU is owned by 1000283696 Ontario Inc and managed by Mauser Property Management.
Pursuant to section 37 of the Telecommunications Act (the Act), the Commission may require any person to submit information that is necessary for the administration of the Act. Rogers Communications Canada Inc. is requested to provide a response to the attached questions by 4 August 2025, as well as serving a copy of their response on Bell and 1000283696 Ontario Inc. Following the reception of Rogers’ response, Bell and 1000283696 Ontario Inc. will have until 13 August 2025 to comment on the RFI responses. These comments must be limited to only the new information provided in the RFI responses.
As set out in section 39 of the Act, and in Broadcasting and Telecom Information Bulletin CRTC 2010-961, Procedures for filing confidential information and requesting its disclosure in Commission proceedings, persons may designate certain information as confidential. A detailed explanation on why the designated information is confidential and why its disclosure would not be in the public interest must be provided, including why the specific direct harm that would be likely to result from the disclosure would outweigh the public interest in disclosure. In addition to the confidential version, an abridged version of the document omitting only the confidential information must be filed or reasons why an abridged version cannot be filed must be provided.

Request for Information – Questions for Rogers Communications Canada Inc.:
- Confirm whether you have any telecommunications equipment, including copper wire, fibre-based and wireless equipment, installed at the multi-dwelling unit (MDU) located at 203 Mauser Avenue, Kitchener, Ontario.
- Provide the technical specifications of the telecommunications equipment installed and used to provide services to residents/customers in the above-referenced MDU. During this application process, Mauser has requested that Bell provide service in the building using a technical solution similar to that of Rogers. The purpose of this inquiry is to determine whether Bell can replicate the specifications used by Rogers. Therefore, it is expected that the response to this question be as detailed as possible and shared with Bell, Mauser, and the Commission
- Provide a copy of all access agreements concluded with 1000283696 Ontario Inc. or any other entity which provide access to the above-referenced MDU for the purpose of installing equipment and providing telecommunications services to residents/customers.
- Provide the total number of customers in the above-referenced MDU to whom you currently provide telecommunications services.

In its application, Bell is requesting that the Commission impose the following order, among others:
“[…] Unless we report that we have been granted access in accordance with the terms and conditions prescribed by the Commission, then the Commission will consider that Bell's access to the MDU continues to be denied. If the Bell access denial continues at 30 days following the issuance of the Commission's decision, a further order prohibiting any LECs and carrier ISPs serving the MDU from:
- Providing service to any new occupants (e.g. those tenants not occupants as of the date the access denial began);
- Providing services to any current occupants who are not an existing customer of the service provider; and
- Modifying or upgrading services provided to any occupants.”
In the event that the Commission finds that Bell is being denied non-discriminatory and timely access to the above-referenced MDU, comment on the possibility that the Commission impose the above order.
- Confirm whether you are aware of any other telecommunication service providers serving tenants or who have telecommunications facilities installed in the MDU. If applicable, provide the name of the telecommunication service provider(s).
