Subject: Part 1 Application Seeking Forbearance of Residential and Business Local Exchange Services in the Incumbent Exchanges of Independent Telecommunications Providers Association Member Companies – Response to ITPA’s Procedural Request
Dear Johnathan L. Holmes,
On 31 March 2025 the Commission received a Part 1 Application (the Application) from the Independent Telecommunications Providers Association (ITPA) seeking forbearance of residential and business local exchange services in the incumbent exchanges of ITPA member companies. The Commission received six interventions. The deadline for interventions was 9 May 2025, and the current deadline for replies is 20 May 2025.
On 12 May 2025, the IPTA filed a procedural request with the Commission to extend the deadline for replies from 20 May 2025 to 27 May 2025. The ITPA submitted that it has limited staff and requires the assistance of an external consultant with this proceeding. The ITPA indicated that for reasons beyond its control, this consultant will be unavailable to assist the ITPA during the time leading up to the current deadline for replies. The ITPA also noted that the requested extension would not disadvantage any interested parties.
Commission staff considers that additional time would allow the ITPA to fully consider the arguments submitted by the intervenors, with assistance from its consultant, and submit a complete reply. Further, the request is for a short extension and will not disadvantage other interested parties.
Accordingly, Commission staff confirms that the deadline to file replies in this process is extended until 27 May 2025.
