Subject: Fibernetics Corporation Part 1 Application for relief alleging undue preference by Rogers Communications Canada Inc. relating to their Southern Alberta Third Party Internet (TPIA) service
Dear Howard Slawner,
In a Staff Letter dated 4 March 2025, the Commission issued Requests for Information (RFIs) in the above captured proceeding to Fibernetics Corporation (“Fibernetics”) and Rogers Communications Canada Inc. (Rogers). The Commission received Rogers’ and Fibernetics’ responses to the RFIs on 14 March 2025.
On 19 March 2025, the Commission received an intervention from TekSavvy, requesting the disclosure of information designated as confidential in Rogers’ RFI responses.
On the same day, in its reply to Rogers’ response, Fibernetics requested that Rogers disclose only to Fibernetics the name of the other TPIA customer that Rogers stated has installed its equipment at Rogers’ point of interconnection (POI) facility.
Rogers is invited to comment on the two requests for disclosure by 13 May 2025. Rogers’ comments must be limited to the requests for disclosure.
As set out in section 39 of the Act, and in Broadcasting and Telecom Information Bulletin 2010-961 (Procedures for filing confidential information and requesting its disclosure in Commission proceedings), persons may designate certain information as confidential. A detailed explanation on why the designated information is confidential and why its disclosure would not be in the public interest must be provided, including why the specific direct harm that would be likely to result from the disclosure would outweigh the public interest in disclosure. In addition to the confidential version, an abridged version of the document omitting only the confidential information must be filed or reasons why an abridged version cannot be filed must be provided.
Where a document is to be filed or served by a specific date, the document must actually be received, not merely sent, by that date.
