Subject: Response to the Ontario Association of Broadcasters’ letter relating to the terms of reference of a proceeding
This letter is in response to your correspondence dated 20 March 2025 regarding the terms of reference of Broadcasting Notice of Consultation 2025-52 – the Path Forward – Supporting Canadian and Indigenous audio content (NoC 2025-52).
In your letter, the Ontario Association of Broadcasters (OAB) express concern that NoC 2025-52 does not, in your view explicitly recognize the need for equitable regulatory treatment between Canadian broadcasters and foreign digital platforms. Based on these concerns, you call on the Commission to reissue the notice with new terms of reference.
The proceeding serves to review many policies and regulatory tools that support Canadian and Indigenous audio content. NoC 2025-52 is broad in scope, and is structured such that it provides all stakeholders, whether online or traditional, commercial or non-commercial broadcasters, content creators, and diverse Canadians, with the opportunity to make submissions on areas of particular interest to them. As I outlined in a letter to the Canadian Association of Broadcasters on March 18th, we have included questions specifically meant to elicit comments on what would constitute fair regulatory treatment, and whether the current regulatory burden is appropriate.
All submissions will be given due consideration by the Commission as part of this proceeding. The preliminary views expressed in NoC 2025-52 are intended to stimulate discussion. The Commission has made no decisions at this time and remains open-minded on the matters. Please note that your concerns are well noted, and we appreciate you reaching out on behalf of your members.
We encourage you and your members to share any specific comments and proposals you may have on the CRTC’s audio policies and tools in support of Canadian and Indigenous audio content by filing interventions through this proceeding. As announced in 2025-52-2, the deadline for the submission of interventions has been extended to 5 May 2025. The deadline for the filing of replies is 29 May 2025.
