Subject: Part 1 Application by TekSavvy Solutions Inc. to address Rogers’ activities to decommission or remove coaxial facilities – Requests for information

On 29 May 2024, TekSavvy Solutions Inc.’s (TekSavvy) filed a Part 1 application, which raised concerns about Rogers Communications Inc.’s (Rogers’) plan to replace its legacy coaxial-based last-mile access facilities with fibre-to-the-premises facilities (FTTP) to buildings located at 191 and 201 Sherbourne Street in Toronto (the two Buildings).

On 12 June 2024, Commission staff issued a letter suspending TekSavvy’s Part 1 application, noting that TekSavvy and Rogers had reached an agreement to address the immediate concerns raised in the application. The letter also noted that some of the concerns raised in TekSavvy’s application will be addressed in the decision resulting from Telecom Notice of Consultation 2023-56 (NoC 2023-56).

On 13 August 2024, the Commission published Telecom Regulatory Policy 2024-180 in response to NoC 2023-56. On the same day, Commission staff issued a letter noting that issues related to decommissioning practices will be subject to additional process and consideration of TekSavvy’s application remains suspended.

Commission staff is reopening the file to gather additional information. This information will be included on the record of the Part 1 application as well as on the record of the future process related to decommissioning practices. Considering that issues related to decommissioning practices will be subject to further process, TekSavvy and Rogers are requested to maintain their current agreement until that process can be resolved.

Questions to Rogers

  1. Specify the number of wholesale high-speed access services that are being provided at the two Buildings?
  2. Specify any additional one-time and recurring costs that are being incurred by Rogers to fulfill its agreement with TekSavvy? Specify any additional one-time and recurring costs associated with each individual connection, if any?
  3. Beyond costs, identify other factors and impacts to Rogers to maintain the wholesale HSA access service at the two Budlings?
  4. Identify competitive fibre-based access alternatives available to competitors at the two Buildings?

Questions to TekSavvy

  1. Specify the number of high-speed access subscribers at the two Buildings?
  2. Specify any additional one-time and recurring costs that are being incurred by TekSavvy to fulfill its agreement with Rogers? Specify any additional one-time and recurring costs associated with each individual connection, if any?
  3. Beyond costs, identify other factors and impacts to TekSavvy to serve its retail subscribers at the two Buildings?
  4. Identify competitive fibre-based wholesale access alternatives available to serve subscribers at the two Buildings?

Rogers and TekSavvy must file their response by 29 November 2024.
