Subject: Part 1 Application by TekSavvy Solutions Inc. to address Cogeco’s activities to decommission or remove coaxial facilities – Requests for information

On 22 December 2023, TekSavvy Solutions Inc.’s (TekSavvy) filed a Part 1 application, which raised concerns about Cogeco Communications Inc.’s (Cogeco) plan to replace its legacy coaxial-based last-mile access facilities with fibre-to-the-premises facilities (FTTP) to certain premises in Burlington and a multi-dwelling unit in Windsor (the two Sites).

On 8 April 2024, the Commission issued an interim order directing Cogeco to maintain competitor access to all premises at the two Sites using one of three methods proposed in TekSavvy’s Part 1 application. Further, the Commission suspended its consideration of TekSavvy’s application until a decision was issued in the proceeding commenced by Telecom Notice of Consultation 2023-56 (NoC 2023-56).

On 13 August 2024, the Commission published Telecom Regulatory Policy 2024-180 in the NoC 2023-56 proceeding. On the same day, Commission staff issued a letter advising the parties that issues related to decommissioning practices will be subject to additional process and as such consideration of TekSavvy’s application remains suspended. Staff reminded Cogeco that the Commission’s interim order to maintain competitive wholesale HSA access to all premises at the two Sites remained in force until the Commission disposed of TekSavvy’s Part 1 application.

Commission staff is reopening the file to gather additional information. This information will be included on the record of the Part 1 application as well as on the record of the future process related to decommissioning practices. As noted in the 13 August 2024 staff letter, pursuant to the Commission’s interim order, Cogeco is required to maintain competitive wholesale HSA access to all premises at the two Sites pending until the Commission has disposed of TekSavvy’s Part 1 application.

Requests for information

Questions to Cogeco

  1. For each of the two Sites, specify which method has been used to maintain competitor access to premises at the two Sites?
  2. Specify the number of wholesale high-speed access services that are being provided at each of the two Sites?
  3. Specify any additional one-time and recurring costs that are being incurred by Cogeco to maintain the wholesale HSA access service at the two Sites? Specify any additional one-time and recurring costs associated with each individual connection, if any?
  4. Beyond costs, identify other factors and impacts to Cogeco to maintain the wholesale HSA access service at the two Sites?
  5. Identify competitive fibre-based access alternatives available to competitors at the two Sites?

Questions to TekSavvy

  1. For each of the two Sites, specify which method has been used to obtain competitor access to serve subscribers at the two Sites?
  2. Specify the number of high-speed access subscribers at each of the two Sites?
  3. Identify competitive fibre-based wholesale access alternatives available to serve subscribers at the two Sites?

Cogeco and TekSavvy may file their answer by 29 November 2024.
