Subject: Review of the wholesale high-speed access service framework, Telecom Notice of Consultation 2023-56: Request for Information from Bell Canada and Telus – Procedural Request
Dear Phillipe Gauvin and Stephen Schmidt:
We are following up on a procedural request made by Bell Canada on 7 August 2024. Bell Canada asked the Commission to order the disclosure of the number of subscribers on TELUS Communications Inc.’s (Telus) temporary aggregated fibre-to-the premises (FTTP) services. This information was filed in response to a Commission request for information (RFI). Bell Canada also asked the Commission to strike from the public record policy arguments that Telus filed in its RFI response.
We are writing to inform you of the Commission’s decision in this matter.
The Commission finds that the requested information for disclosure has limited commercial value to competitors and that its disclosure is unlikely to cause specific direct harm to Telus, given that Telus’ temporary aggregated FTTP service will remain available for only a short period of time. Sharing the requested information is also in the public interest as it provides information on the overall demand for temporary aggregated FTTP services, when combined with Bell Canada’s information. Accordingly, the Commission concludes that Telus should publicly disclose the requested subscriber information.
The Commission notes that the policy arguments made by Telus in its RFI response were not responsive to the RFI and were outside the scope of the request. Accordingly, the Commission concludes that the policy arguments were improper and should be struck from the record.
As a result, the Commission directs Telus to file a revised version of its RFI response by 24 October 2024, with the following changes:
- publicly disclose the total number of subscribers on Telus’ temporary aggregated FTTP service, as provided in the confidential version of Telus’ RFI response received on 30 July 2024; and
- remove all information that follows the first unnumbered paragraph in Telus’ original RFI response received on 30 July 2024.
