Subject: Part 1 Application by TekSavvy Solutions Inc. on the decommissioning of copper

On 29 May 2024, the Commission received an application from TekSavvy Solutions Inc. (TekSavvy). The application requests that the Commission provide relief related to the imminent decommissioning of hybrid fibre coaxial (HFC) facilities in buildings located at 191 and 201 Sherbourne Street in Toronto.

On 31 May 2024, Commission staff issued a letter requesting that Rogers maintain TekSavvy’s ability to serve its customers at these locations until the Commission can issue a decision on this application. In its letter, Commission staff set out a process to consider TekSavvy’s request, with Rogers and members of the public to submit their interventions by 14 June 2024, and TekSavvy to file its reply by 21 June 2024.

On 11 June 2024, TekSavvy sent a letter to the Commission informing it that an agreement had been reached with Rogers to address the immediate concerns raised in its application and requesting that its application be suspended until a decision is issued in Telecom Notice of Consultation (NoC) 2023-56.

As some of the issues raised in TekSavvy’s application will be addressed in the decision resulting from NoC 2023-56, Commission staff agrees that it would be in the interest of the parties to temporarily suspend the process associated with this application until further notice.
