Subject: Application to Review & Vary Telecom Decision CRTC 2022-311

Dear Mr. Contzen,

I am writing regarding the application dated 27 February 2023 filed on behalf of British Columbia’s Ministry of Transportation and Infrastructure (MOTI) requesting that the Commission review and vary Telecom Decision 2022-311 and, specifically, that the Commission rescind the directives to MOTI in Decision 2022-311 at paragraphs 99 and 106 (the Directives). Pursuant to the Directives, the Commission required that MOTI enter into agreements with any other carrier that requests one and include terms no less favourable than those provided to TELUS Communications Inc. (TCI), applying only to poles owned by TCI. Importantly, the Directives remained in effect only until Commission approval of TCI’s revised tariff pages.

In Telecom Order CRTC 2024-122, TELUS Communications Inc. – Tarriff Notice 576 – Amendment to Support Structure Service, published today, the Commission approves on an interim basis an amendment to TCI’s General tariff. Therefore, as the Commission has approved revised tariff pages, the Directives are no longer in effect. Accordingly, the request to rescind the Directives filed by MOTI is now moot.

Please confirm whether or not you wish to have the Commission consider your application. If you indicate in the affirmative, you may file comments as to why the Commission should still consider the application and render a determination given that the Directives are no longer in effect.
