Subject: TELUS Tariff Notice 590 – Support Structure Pole Rental Rate Change – Response to Cable Carriers request for extension
On 26 April 2024, TELUS Communications Inc. (TELUS) filed Tariff Notice (TN) 590 to revise the tariff pages for its General Tariff CRTC 21461, Item 404 – Support Structure Service, to reflect the updated monthly pole rental rate per unit.
On 17 May 2024, Bragg Communications Inc., carrying on business as Eastlink; Quebecor Media Inc., on behalf of its subsidiaries Videotron Ltd. and Freedom Mobile Inc.; and Rogers Communications Canada Inc. (collectively, the Cable Carriers) requested disclosure of information filed by TELUS in confidence in the above-noted tariff filing.
The Cable Carriers further asked the Commission to extend the current date for comments from 5 June 2024 to 21 June 2024, to provide intervenors with an opportunity to address any additional information disclosed by TELUS. The Cable Carriers also requested the Commission to modify the process to review TN 590 to include an interrogatory phase.
On 27 May 2024, in its response to requests for disclosure, TELUS addressed and commented on the various requests made by the Cable Carriers. With respect to extending the 5 June 2024 deadline for the filing of Interventions on TN 590, TELUS stated that it disclosed a limited amount of supplementary information that can be reviewed by Cable Carriers within the standard timelines for tariff applications. TELUS was of the view that the Cable Carriers and other parties would have ample time to provide their comments by the 5 June 2024 deadline.
Commission staff considers that it is important for these tariff proceedings to be efficient to ensure the timely implementation of any potential changes. Upon review of the Cable Carriers' requests and the additional information disclosed by TELUS, Commission staff is of the view that the 5 June 2024 deadline allows sufficient time for the Cable Carriers and other parties to file their comments.
Accordingly, the deadline to submit interventions remains 5 June 2024 and the reply deadline for TELUS remains 17 June 2024.
With respect to the other requests made by the Cable Carriers, Commission staff will provide guidance on these requests in due course.
