Subject: Procedural request from TELUS Communications Inc.
Dear Stephen Schmidt,
We are writing to inform you of the Commission’s decision on a procedural request filed by TELUS Communications Inc. (TELUS) on 28 February 2024 (the Request). The Request was made in respect of the merged Part 1 applications to extend the Enhanced 9-1-1 decommissioning date (the Proceeding).
In the Request, TELUS claims that E-Comm Emergency Communications for British Columbia Inc. (E-Comm) breached the CRTC Rules of Practice and Procedure by introducing new facts in its reply submissions.
The Commission takes procedural fairness seriously. The Commission notes that the allegations referenced in the Request are not directly related to the Proceeding. Rather, they are more relevant to another proceeding—the Part 1 application for NG9-1-1 Pre-Production Testing and Quality Assurance Program (8662-C126-202305797). Therefore, providing TELUS with a further right of reply in the Proceeding would not be efficient.
As such, the Commission will disregard, in the Proceeding, the submissions by both TELUS and E-Comm related to the allegations referenced in the Request. Instead, the Commission will request further information from TELUS and E-Comm on the record of the other proceeding. This will provide both TELUS and E-Comm the opportunity to present their respective positions, consistent with the principles of procedural fairness.
Accordingly, the Commission denies TELUS’ procedural request.
