Subject: Final offer arbitration regarding mobile virtual network operator access rates

Dear Stephen Schmidt,

We are writing to inform you of the Commission’s decision on whether the Cost Study Report filed on 13 February 2024 by TELUS Communications Inc. (TELUS) should be part of the record of the Final offer arbitration (FOA) process with Québecor Media Inc. (QMI).

As stated in Broadcasting and Telecom Information Bulletin 2019-184 (the Bulletin), parties must provide a submission that is at most 30 pages and that sets out all arguments and facts concisely. Also, as you know, the Commission may occasionally ask for additional information and data through requests for information (RFI) to ensure it has a fulsome record.

Having considered the submissions from TELUS and QMI, the Commission will retain the TELUS Excel spreadsheets on the record since they were requested in RFIs. At the same time, the Commission has decided to strike TELUS’ Expert Report from the record because it goes beyond providing the data and information requested in the RFIs.

While TELUS is entitled to present arguments and justifications, the Commission considers that it must do so in a way that respects procedural fairness and that is consistent with the rules set out in the Bulletin. In arriving at this decision, the Commission is also applying the principles of effective regulation set out in the Order Issuing a Direction to the CRTC on a Renewed Approach to Telecommunications Policy, SOR/2023-23, 10 February 2023, ensuring that its proceedings and decisions are transparent, predictable and coherent, and that the measures that it imposes through its decisions are efficient and proportionate to their purpose.
