Subject: Notice of hearing – Review of the wholesale high-speed access service framework, Telecom Notice of Consultation 2023-56 – Procedural request for expedited ruling and alternative request for interim relief

Bell Canada, Bragg Communications Inc. carrying on business as Eastlink, Cogeco Communications Inc., on behalf of its subsidiary Cogeco Connexion Inc., Competitive Network Operators of Canada, and TekSavvy Solutions Inc., collectively the Signatories, filed a request on 28 March 2024 (the Request) regarding the Commission’s ongoing review of its wholesale high-speed access (HSA) service framework.

The Request seeks an expedited ruling from the Commission, prior to 7 May 2024, to make Bell Canada, Rogers Communications Canada Inc., TELUS Communications Inc., and their affiliates (collectively the National Carriers) ineligible to access mandated aggregated wholesale HSA services over fibre-to-the-premises facilities (aggregated FTTP services).

More specifically, the Signatories request that the Commission expedite the process to close the record of Telecom Notice of Consultation 2023-56 (NoC 2023-56) only on the issue of the National Carriers’ access to aggregated FTTP services and issue a decision on this matter before the temporary aggregated FTTP services mandate comes into effect on 7 May 2024, pursuant to Telecom Decision 2023-358. That single-issue decision would apply to both the existing temporary aggregated FTTP services and to any future final aggregated FTTP services that may be ordered when the Commission issues its decision related to NoC 2023-56.

In the alternative, the Signatories requested that, should the Commission be unable to provide a final ruling on this issue before 7 May 2024, it issue a ruling granting interim relief to prevent the National Carriers from being able to access temporary aggregated FTTP services on 7 May 2024. In this regard, the Signatories argued that they meet all of the elements of the three-part test set out in RJR-MacDonald v Canada (Attorney General).

Procedural steps

In the Request, the Signatories proposed process specific to the consideration of their interim relief request but did not suggest process for consideration of their primary procedural request.   This letter sets out process for consideration of both matters. 

Parties are invited to file their comments on the Signatories’ requests by 12 April 2024.

Given the importance of limiting delays to the conduct and conclusion of the proceeding and having regard to the Signatories’ request to waive any right of reply on the interim relief request, no reply phase will be established.
