Subject: Procedural request to close or suspend the proceeding related to the Part 1 application by the Association des professionnels de l’édition musicale (2024-0491-1)
Dear Marc Nanni,
Thank you for your request regarding the Part 1 application filed by the Association des professionnels de l’édition musicale (APEM) asking the Commission to collect and publish data from the main online music services, as detailed in 2024-0491-1 (the Application). The Commission greatly values the interest and participation of all persons in its proceedings.
On 16 October 2024, you filed a procedural request asking the Commission to close this application or suspend it until the disposal of your request. The deadline for interventions related to this application is 28 October 2024.
The Commission has reviewed your request and considers APEM’s application to be relevant to the work undertaken to modernize the broadcasting regulatory framework as a result of the Online Streaming Act. The Commission is of the view that it is in the public interest to receive comments and allow the proceeding to follow its normal course.
For these reasons, the Commission has determined that the dismissal or suspension of the application is unjustified. Following the end of the intervention and reply periods, the Commission will make a decision informed by the public record of the application. In this regard, I wish to confirm that the viewpoints you expressed in the procedural request filed on 16 October 2024 will form part of the public record of the application.
