Subject: Confidentiality request for your letter regarding application of the Online News Act
Thank you for your response.
We have noted your request for confidentiality. Section 55 of the Online News Act provides that organizations may designate certain information submitted to the Commission as confidential if it falls into one of the categories outlined in that section. For confidential information, the Commission relies on the procedures set out in Broadcasting and Telecom Information Bulletin 2010-961.
A detailed explanation of why the designated information is confidential and why its disclosure would not be in the public interest must be provided, including why the specific direct harm that would be likely to result from the disclosure would outweigh the public interest in its disclosure. An abridged version of the document omitting only the confidential information must also be filed with the Commission. Alternatively, reasons why an abridged version cannot be filed must be provided.
Other organizations may request the disclosure of information that has been submitted confidentially, in which case, the Commission would make a decision whether or not to disclose the information based on whether the information properly falls into one of the categories of information that can be designated as confidential and whether disclosing it would be in the public interest.
Please file an abridged version along with your request for confidentiality by no later than October 28, 2024.
