CJBC Toronto and CBEF Windsor – Licence amendments
- The Commission has the authority, pursuant to subsection 9(1) of the Broadcasting Act (the Act), to issue licences for the carrying on of broadcasting undertakings as well as to amend those licences.
- Consistent with this authority, the Commission approves the application (2024-0118-1) by the Canadian Broadcasting Corporation (CBC) to amend the broadcasting licence for the French-language AM radio programming undertaking CBEF Windsor, Ontario, to transfer to that licence the rebroadcasting transmitter CJBC-4-FM London, Ontario, which currently rebroadcasts the programming of the French-language AM radio station CJBC Toronto, Ontario. All other technical parameters will remain unchanged.
- The Commission also approves the application (2024-0119-9) by the CBC to amend the broadcasting licence for the French-language AM radio programming undertaking CJBC Toronto to delete the rebroadcasting transmitter CJBC-4-FM London.
- The Commission received two interventions in support of application 2024-0118-1 and one intervention in support of application 2024-0119-9, to which the CBC replied.
- When a licensee files an application for technical changes, the Commission generally requires the licensee to present compelling technical or economic evidence justifying the requested changes. The Commission may, as an exception to this general approach, approve applications that do not provide compelling technical or economic evidence where the particular circumstances warrant it.
- In this case, the licensee indicated that the French-language official language minority community in the London area requested these changes. It stated that the community indicated it preferred the Windsor signal, which better reflects its reality.
- While the licensee has not demonstrated a technical or economic need, the Commission considers that the licensee has demonstrated that these changes would serve the public interest and better meet the needs of London’s French-language community. Therefore, the Commission has no concerns regarding these applications.
