Changes to procedure

  1. On 5 November 2024, the Commission received a procedural request from Deaf Wireless Canada Committee et al. (DWCC et al.)Footnote 1 to extend the intervention and reply deadlines set out in Broadcasting Notice of Consultation 2024-137.
  2. DWCC et al. requested a two-week extension of time, ending 29 November 2024, to submit a report on the survey it is conducting of Deaf, Deaf-Blind, and hard of hearing individuals.
  3. In support of this extension, DWCC et al. stated that it has received more interest from Deaf-Blind individuals than anticipated and that the current timeline may not provide them sufficient time for any necessary assistance in completing the survey. DWCC et al. stated that an extension of time would ensure that the views of Deaf-Blind individuals are adequately represented in its survey report and that a more comprehensive and representative set of responses from the Deaf-Blind community are included on the record of the proceeding.
  4. Five parties filed letters commenting on the extension request: the Canada Deaf Grassroots Movement (CDGM), the Deaf-Blind Planning Committee (DBPC), the Deaf and Hard of Hearing Coalition (DHH Coalition), the Forum for Research and Policy in Communications (FRPC), and the Public Interest Advocacy Centre (PIAC).
  5. In these letters, three parties supported the extension, while two parties remained neutral on the matter of whether an extension should be granted. Four of the five parties that filed letters asked that any extension of deadlines apply to all parties.
  6. The Commission considers that despite the longer than normal timeframe initially provided for the intervention and reply periods, as well as the previous extension to the intervention and reply deadlines (see Broadcasting Notice of Consultation 2024-137-1), the input of Deaf-Blind individuals will offer unique perspectives that are valuable to the present proceeding and will result in a more fulsome record.
  7. Further, the Commission considers that this extension would be consistent with the principles of the Accessible Canada Act.
  8. The Commission considers that it would be equitable to extend the intervention period for all parties. The DHH Coalition requested the longest extension of time, and therefore the Commission is using its proposed dates as the new deadlines for all parties.
  9. Accordingly, the Commission extends the intervention deadline set out in Broadcasting Notice of Consultation 2024-137-1 to 11 December 2024 and the deadline for the submission of replies to 29 January 2025. This will give those parties submitting their comments in American Sign Language (ASL) or Langue des signes québécoise (LSQ) enough time for video production.
  10. The Commission reminds potential intervenors, and advises those new to the Commission’s consultation process, of the role of the Broadcasting Participation Fund (BPF) in providing cost support and encourages them to consult the BPF to determine what costs may be reimbursed in this context.
