RE: Tariff Notices filed pursuant to Telecom Notice of Consultation CRTC 2023-56, Notice of hearing – Review of the wholesale high-speed access service framework

In Notice of hearing – Review of the wholesale high-speed access service framework, Telecom Notice of Consultation 2023-56, dated 8 March 2023 (NoC 2023-56), the Commission directed all wholesale high-speed access (HSA) service providersFootnote1 to file proposed tariffs and associated cost studies using the Phase II costing methodology, with supporting rationale, for fibre-to-the-premises (FTTP) facilities over aggregated wholesale HSA services by 24 April 2023, and to file new Phase II cost studies to establish rates for aggregated wholesale HSA services by 22 June 2023.

Through a series of Secretary General and staff letters, the timelines for submission of Phase II cost studies were amended as follows: Shaw was granted an extension to file its tariff application providing for aggregated wholesale high-speed access services using FTTP access facilities and associated cost studies from 24 April 2023 to 24 August 2023; and all incumbent carriers (excluding Shaw) were granted an extension to the deadlines to file the tariff applications and cost studies for FTTP facilities over aggregated wholesale HSA services from 24 April 2023 to 31 May 2023.

In response to a procedural request from TekSavvy submitted on 8 September 2023 seeking clarity on the procedure for submitting replies and comments on updates to the tariff applications, Commission staff issued a letter 17 October 2023 requesting that parties do not file interventions with respect to the wholesale HSA tariff applications until advised as to the next steps in the evaluation process by way of a procedural letter.

Commission staff continues its analysis of the submissions by the incumbent companies.  The Commission is further in receipt of several updates / amendments to original proposed rate submissions.  To help ensure a full and complete record, staff is setting the following process for amendments to the tariff applications from Bell Canada (TN 7664A and TN 7671) and SaskTel (TN 378B):

  1. Disclosure-related process
    • Requests for disclosure to be filed and served by 20 November 2023
    • Replies to requests for disclosure to be filed and served by 30 November 2023
  2. Submissions
    • Interventions to be filed and served 20 after Letter on Disclosure Request
    • Replies to Interventions to be filed 30 days after Letter on Disclosure Request

Disclosure requests for which process has already been established will be dealt with in a forthcoming letter.

Commission staff notes that the timelines established for the filing of proposed tariffs and associated rates for both aggregated wholesale HSA over FTTP and aggregated wholesale HSA services have since passed, and that certain incumbent submissions are currently outstanding. Commission staff considers, however, that there remains a strong public interest in the issuance of a timely decision in this proceeding. As a result, and in an effort to support an efficient process, effective the date of this letter, new proposed tariff and associated proposed rates will not be considered, including amendments to existing proposed rates, or submissions for new proposed rates, for consideration as part of the tariff proceedings arising out of Notice of Consultation 2023-56. Notwithstanding, revisions or amendments may be requested by Commission or Commission staff if deemed necessary and appropriate.
