Subject: Temporary suspension of the Part 1 application (Application) filed by CIK Telecom Inc. (CIK), requesting non-discriminatory and timely access on reasonable terms and conditions to Multi-Dwelling Units (MDUs) owned by Strata Corporation EPS 1653 (EPS 1653)

In a letter dated 20 March 2023, Commission staff temporarily suspended CIK’s Application for the express purpose of enabling the parties to conduct good faith negotiations towards concluding an access agreement. Additionally, to assist the Commission in assessing the progress of negotiations and to ensure that parties were negotiating in good faith, both CIK and EPS 1653 were required by Commission staff to submit a bi-weekly report on the status of their ongoing negotiations, with the final report due by 1 May 2023.

In the letter, staff stipulated that in the case where negotiations did not result in an agreement regarding access by CIK telecom to the MDUs in question, staff would assess appropriateness of reinstating CIK’s Application. Accordingly, staff required CIK and EPS 1656 to comment in their respective 1 May 2023 reports whether it would be appropriate for the Commission to maintain the suspension. However, neither party explicitly commented in their 1 May 2023 reports regarding the appropriateness of maintaining the suspension.

Staff therefore directs CIK to report on the progress of negotiations since 1 May 2023, and for CIK to inform the Commission by 21 July 2023 regarding whether:

  1. CIK wishes to maintain the suspension, reinstate, or withdraw its Application;
  2. CIK believes an extension of the suspension is or is not appropriate, with reasons provided.

Staff additionally directs EPS 1653 to report on the progress of negotiations since 1 May 2023, and for EPS 1653 to inform the Commission by 21 July 2023 regarding whether EPS 1653 believes an extension of the suspension is or is not appropriate, with reasons provided.
