Subject: Telecom Notice of Consultation 2023-56 - Review of the wholesale high speed access framework - Notice that the tariff notices will not be disposed of by the 45th business day following receipt 

On March 8th, 2023, the Commission initiated Notice of Consultation 2023-56 (the Notice) to conduct a fulsome review of the wholesale high-speed access service framework including services offered through aggregated HSA regime.

In the Notice, the Commission directed incumbent carriers to file proposed tariffs and associated cost studies using Phase II costing methodology with supporting rationale for FTTP facilities over aggregated wholesale HSA services by 24 April 2023.  The Commission also directed incumbent carriers to file new Phase II cost studies to establish rates for aggregated wholesale HSA services by 22 June 2023.  On 20 April 2023, by way of a Secretary General letter, the Commission approved a request by Shaw Cablesystems G.P. (Shaw) to exclude its legacy FTTP facilities from its tariff application and cost study for FTTP facilities over aggregated wholesale HSA services, and further approved an extension to 24 August 2023 to file the tariff application and cost study for Shaw’s FTTP service.  On 4 May 2023, by way of a Secretary General letter, the Commission approved an extension to the deadlines for incumbent carriers (with the exception of Shaw) to file their tariff applications and cost studies for FTTP facilities over aggregated wholesale HSA services to 31 May 2023.

Commission staff is continuing its analysis of the applications received.  Furthermore, the need to dispose of many of these tariff applications is itself contingent on a policy decision yet to be made by the Commission. Consequently, these applications will not be disposed of by the 45th business day following receipt of the applications.  Further correspondence on this matter will be provided as appropriate.
