RE: TELUS Communications Inc. Tariff Notices (TNs) 580 and 655 – Amendment to Support Structure Service Tariffs

Dear Carol:

On 3 April 2023, the Commission received applications from TELUS Communications Inc. under TNs 580 and 655 in which the company proposed revisions to General Tariff CRTC 21461, Item 404, Support Structure Service and CRTC 25080, Item 4.12, Service de structures de soutènement. The proposed revisions were filed to reflect the directives in Regulatory measures to make access to poles owned or controlled by Canadian carriers more efficient, Telecom Regulatory Policy CRTC 2023-31, 15 February 2023 as amended by Telecom Regulatory Policy CRTC 2023-31-1, 22 March 2023.

Given that these tariff applications address services generally used by Competitors, Commission staff is of the view that it is more appropriate to process these applications as Competitor tariff applications as set out most recently in Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455-1, 19 February 2016 (TIB 2010-455-1).

Accordingly, the above noted TNs will be treated as Competitor applications in accordance with TIB CRTC 2010-455-1. Commission staff does not require that the tariff applications be re-filed to reflect this change.
