Subject: Part 1 Application of Execulink Telecom Inc. requesting non-discriminatory and timely access on reasonable terms and conditions to MDUs managed by Williams & McDaniel Property Management

Dear Ian Stevens and Haseeb Khan,

On 24 February 2023, the Commission received an application from Execulink Telecom Inc. (Execulink), filed under Part 1 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure. In its application, Execulink sought relief from what it submitted was a denial of timely access under reasonable terms and conditions to multi-dwelling units (MDUs) owned by Williams & McDaniel Property Management (Williams & McDaniel); located at 64 Devonshire Avenue, 66 Devonshire Avenue, 3 Erie Court, 4 Erie Court and 207 Lisgar Avenue, in Tillsonburg, Ontario.

On 17 March 2023, the Commission received a letter from Execulink, informing that it has executed an access agreement with Williams & McDaniel Property Management. Execulink informed that it was therefore withdrawing its Part 1 application, and requested that the Commission close the corresponding proceeding.

In light of the above, Commission staff advises that the above-referenced Part 1 application from Execulink is now closed.
