Subject: Part 1 Application by Globalive Inc. to address the requirement for Just and Reasonable Rates required by Section 27(1) of the Telecommunications Act and Undue Preferences contrary to Section 27(2) of the Telecommunications Act for Mandated Wholesale Domestic Roaming

Dear Simon Lockie,

The Commission is in receipt of the above-noted Part 1 Application from Globalive Inc. (Globalive) dated 23 February 2023. In this regard, please be advised that the issues Globalive has raised concerning wholesale roaming tariff rates in its Part 1 Application are currently before the Commission in an ongoing proceeding stemming from a separate Part 1 Application, dated 19 May 2023, which was filed jointly by Bragg Communications Inc., carrying on business as Eastlink (Eastlink), Cogeco Communications Inc., on behalf of its subsidiary Cogeco Connexion Inc. (Cogeco), Quebecor Media Inc., on behalf of its subsidiary Videotron Ltd. (Videotron) and Xplornet Communications Inc. and Xplore Mobile Inc. (together, “Xplornet”) (together the Applicants).  

In particular, the Applicants requested that the Commission: (i) initiate a comprehensive review of the wholesale roaming tariff rates of Bell Mobility Inc. (Bell Mobility), Rogers Communications Canada Inc. (Rogers), and Telus Communications Inc. (TELUS) (collectively “the National Wireless Carriers”); (ii) state its intent to consider a mechanism whereby any newly approved wholesale roaming rates will decline on an annual basis thereafter, and (iii) immediately declare all the wholesale roaming tariff rates of the National Wireless Carriers to be interim rates.

Given that the relief Globalive is seeking regarding wholesale roaming tariff rates is currently before the Commission, it would not be appropriate nor efficient for the Commission to conduct a separate concurrent proceeding on these same issues. As a result, Globalive is hereby notified that its Part 1 application will not be given further consideration and will not be posted for comment on the Commission’s website.
