Subject: Procedural request to appear at the public hearing announced in Broadcasting Notice of Consultation 2023-138

Dear J.J. McCullough,

The Commission received your letter dated 20 October 2023, requesting permission to appear at the public hearing announced in Broadcasting Notice of Consultation 2023-138 (the Notice), which is scheduled to begin on 20 November 2023. 

The procedure set out in the Notice invited the public to make written interventions by 11 July 2023. Interveners wanting to appear at the public hearing were asked to indicate so in their interventions and explain why an appearance is necessary. While you did not file an intervention, you also explained in your letter that you are not familiar with the Commission’s proceedings.

In general, only interveners that submit interventions during the allocated intervention period are invited to the public hearing. This approach is designed to ensure that all parties are aware of the public record and have an opportunity to respond to the positions of the other parties in the proceeding.

On an exceptional basis, given your prominence in publicly advocating for concerns that may be shared with many Youtubers, combined with your involvement in the study of Bill C-11 at the House of Common and the Senate, the Commission approves your request to appear at the public hearing. Your appearance is scheduled on Friday 8 December 2023.

To be able to appear, the Commission requires you to send a written intervention outlining your comments on the issues raised in the Notice to this address: hearing@crtc.gc.ca by 14 November 2023. Your intervention will then be added to the public record of the proceeding.

Once your intervention is received, the Commission will provide you with information on the organization and conduct of the public hearing as well as a point of contact if you have further questions.
