Subject: Part 1 Application to amend the conditions of licence relating to consultations with Indigenous Peoples (Broadcasting Decision CRTC 2022-165)

Ms. Kirshenblatt,

This is in response to the application filed by CBC/Radio-Canada on 22 February 2023, requesting to amend the conditions of licence (COLs) relating to consultations with Indigenous Peoples (the Consultation COLs), so that these consultations begin in the 2023-2024 broadcast year.

I note that one of the arguments raised by CBC/Radio-Canada for requesting the above-noted amendment is the existence of a consultation fatigue experienced by some Indigenous Peoples. You noted that during the engagement sessions conducted by CBC/Radio-Canada from April to November 2022, some communities expressed feeling “over-consulted” by various industries, and cautioned against holding further consultations without a concrete action plan and a concerted effort in strategy development.

It is clear that Indigenous Peoples will be affected by any amendment to the Consultation COLs. As such, and in light of the fact that one of CBC/Radio-Canada’s arguments relies on a concern expressed by members of Indigenous communities, it would seem appropriate to serve the application on groups representing the interests of Indigenous Peoples so that they be informed of the proposed amendment and can intervene, should they decide to.

Accordingly, we are asking you to serve the application on the above-noted groups – including the groups that expressed feeling “over-consulted” during your engagement sessions - and provide the Commission with a list of the persons on whom the application has been served and the email address of each, by 10 May 2023.
