Various campus radio stations – Licence renewals

  1. The Commission has the authority, pursuant to subsection 9(1) of the Broadcasting Act (the Act), to issue and renew licences for such terms not exceeding seven years and subject to such conditions related to the circumstances of the licensee as it deems appropriate for the implementation of the broadcasting policy set out in subsection 3(1) of the Act.
  2. Consistent with that authority, the Commission renews the broadcasting licences for the campus radio programming undertakings listed in Appendix 1 to this decision from 1 September 2023 to 31 August 2030.Footnote 1 The Commission did not receive any interventions in regard to the applications submitted to renew the licences for CFOU-FM Trois-Rivières, CHYZ-FM Sainte-Foy, CISM-FM Montréal and CJIQ-FM Kitchener/Paris. The Commission received interventions from the National Campus and Community Radio Association in support of the 23 other applications addressed in this decision. The terms and conditions of licence for these stations are set out in Appendix 2 to this decision.

Reminders

  1. As set out in Broadcasting Regulatory Policy 2010-499, the board of directors of campus radio stations must include a balanced representation from the student body and representation from the administration of the post-secondary institution, station volunteers and the community at large. The Commission reminds the licensees that they must maintain this balanced representation on their board of directors throughout the licence term. To ensure continuity of direction, the Commission encourages the licensees to establish positions on their board of directors with terms of more than one year.
  2. The Commission also reminds the licensees that they must comply at all times with the Direction to the CRTC (Ineligibility of non-Canadians).Footnote 2
  3. Pursuant to section 22 of the Act, the broadcasting licences renewed in this decision will cease to have any force or effect if the broadcasting certificates issued by the Department of Industry (also known as Innovation, Science and Economic Development Canada) lapse.

Appendix 2 to Broadcasting Decision CRTC 2023-76

Terms, conditions of licence, expectations and encouragement for the campus radio programming undertakings for which the broadcasting licences have been renewed in this decision

Terms

The licence will expire 31 August 2030.

Condition of licence applicable to all stations

  1. The licensee shall adhere to the conditions of licence set out in Standard conditions of licence for campus and community radio stations, Broadcasting Regulatory Policy CRTC 2012-304, 22 May 2012, as well as to the conditions set out into the broadcasting licence for the undertaking.

Additional conditions of licence applicable to CISM-FM Montréal, Quebec

  1. The licensee is authorised to use a subsidiary communications multiplex operation (SCMO) channel for the purpose of broadcasting a predominantly Tamil-language radio service.
  2. The licensee shall, as an exception to the percentage of Canadian musical selections set out in Campus and Community Radio Policy, Broadcasting Regulatory Policy CRTC 2010-499, 22 July 2010, in any broadcast week during which the majority of content category 3 (Special interest music) musical selections are drawn from content subcategory 33 (world beat and international music), devote a minimum of 9% of its musical selections from content category 3 to Canadian selections broadcast in their entirety.

    For the purposes of this condition, the terms “broadcast week,” Canadian selection,” “content category,” “content subcategory” and “musical selection” shall have the same meanings as those set out in the Radio Regulations, 1986.

Additional condition of licence applicable to CIXX-FM London, Ontario

  1. The licensee shall devote, in each broadcast week, two hours of its programming schedule to spoken word programming as researched and produced by students for curriculum requirements.

Additional condition of licence applicable to CJUM-FM Winnipeg, Manitoba

  1. The licensee shall devote, in each broadcast week, part of its programming to one ethnic group.

Additional condition of licence applicable to CKMS-FM Waterloo, Ontario

  1. The licensee shall devote, in each broadcast week, 15 hours to programming broadcast in third languages. This programming shall target a minimum of eight cultural groups in a minimum of eight languages.

Expectations applicable to all stations

As set out in Campus and community radio policy, Broadcasting Regulatory Policy CRTC 2010-499, 22 July 2010, the Commission expects all community and campus licensees to file yearly updates on the composition of their boards of directors. These annual updates can be submitted at the time of submission of annual returns, following annual board of directors’ elections, or at any other time. As noted in Appendix 3 to that policy, licensees may submit such documentation via the Commission’s website.

The Commission expects the licensee to reflect the cultural diversity of Canada in its programming and employment practices.

Encouragement applicable to all stations

The Commission considers that campus and community radio stations should pay particular attention to employment equity in order to reflect fully the communities they serve. It encourages the licensee to consider employment equity in its hiring practices and in all other aspects of its management of human resources.
