Bragg Communications Inc., carrying on business as Eastlink, on behalf of Amtelecom Limited Partnership and People’s Tel Limited Partnership – Withdrawal of general tariffs

The Commission received two applications from Bragg Communications Inc., carrying on business as Eastlink (Eastlink), both dated 28 June 2023. Eastlink submitted Tariff Notice (TN) 86 on behalf of its subsidiary Amtelecom Limited Partnership (Amtelecom) and TN 94 on behalf of its subsidiary People’s Tel Limited Partnership (People’s Tel).
Eastlink proposed to withdraw the general tariffs of both Amtelecom and People’s Tel, which were amalgamated into an affiliated entity, Persona Communications Inc. (Persona), effective 1 September 2022.
Eastlink requested the retroactive effective date of 1 September 2022, which would align the proposed withdrawals with the effective date of Persona’s General Tariff.
The Commission received no interventions with respect to the applications.

The Commission considers that Eastlink’s proposal to withdraw the general tariffs of Amtelecom and People’s Tel is reasonable and complies with the related regulatory policies.
However, regarding the company’s request for a retroactive effective date of 1 September 2022, the Commission notes that, pursuant to Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455-1, 19 February 2016, Eastlink would have needed to file the application at least 60 calendar days before 1 September 2022 in order to have it designated the effective date.
Furthermore, the Commission can only approve a retroactive effective date if it has already approved the application on an interim basis. This is not the case with Eastlink’s application.

In light of the above, the Commission approves Eastlink’s application, effective 11 September 2023 and denies Eastlink’s request for a retroactive effective date.
