Broadband Fund – Change request – South Kountry Cable (2022) Ltd.’s access project in British Columbia
- In Telecom Decision 2022-82, the Commission approved South Kountry Cable (2022) Ltd.’s (South Kountry) funding application to improve the broadband Internet access services available to eligible areas in Jaffray, British Columbia. The Commission later received written acceptance of this funding award from South Kountry and in Telecom Order 2022-327, approved South Kountry’s related statement of work, subject to the conditions of funding set out in Telecom Decision 2022-81.
- Among the conditions of funding is the requirement, set out at paragraph 28 of Telecom Decision 2022-81, that any changes that materially affect the project to be delivered be approved by the Commission. In the Application Guide appended to Telecom Notice of Consultation 2019-372, which initiated the second call for applications and led to Telecom Decision 2022-82 and other decisions introduced in Telecom Decision 2022-81, the Commission defined a change of control as a material change.
- On 26 January 2023, South Kountry filed information indicating that it had been acquired by TELUS Communications Inc. (TCI). On 31 March 2023, TCI submitted a change request seeking to change control of the recipient for the project approved in Telecom Decision 2022-82 from South Kountry to TCI.
- The Commission has reviewed the materials submitted and considers that approving the change request would satisfy the objectives of Telecom Regulatory Policy 2018-377.
- The Commission expects TCI to submit for the Commission’s approval an updated statement of work package for the project no later than 22 September 2023.
- The Commission will temporarily suspend the deadline to file quarterly progress reports and claim forms set out in paragraph 8 of Telecom Order 2022-327 until it issues a decision regarding TCI’s updated statement of work package.
- The Commission approves TCI’s change request to change control of the recipient. All funding conditions and conditions imposed under section 24 of the Telecommunications Act,asset out in Telecom Decision 2022-81, continue to apply to TCI as they had applied to South Kountry, including the Commission’s expectation that the project will be completed within three years of the date of that decision.
