Subject: Compliance and Enforcement Notice of Consultation 2022-218 – procedural request by Beanfield Technologies Inc.
On 19 September 2022, the Commission received an intervention from Beanfield Technologies Inc. (Beanfield) in Compliance and Enforcement Notice of Consultation 2022-218 (NOC 2022-218). Beanfield’s intervention included a procedural request to add the Office of the Privacy Commissioner of Canada (OPCC) as a party to the proceeding, and to modify the reply period to allow other parties to respond to any submissions made by the OPCC.
Rogers Communications Canada Inc., in its reply comments, argued that it was not necessary or appropriate to pause the proceeding to facilitate the OPCC’s participation, and noted that the OPCC could have intervened within the existing timelines had it wished to do so.
The Commission agrees with Beanfield that the OPCC has made valuable contributions to other public proceedings in which it has participated, but notes that the OPCC’s participation in proceedings before the Commission is typically at the OPCC’s own discretion. While the Commission acknowledges that the present proceeding will raise issues relating to the protection of personal privacy that the Commission must have regard for, the Commission does not consider that the mere presence of these issues makes it necessary or appropriate to add the OPCC to a proceeding in which it has not participated, or sought to participate.
In light of the above, the Commission denies Beanfield’s request.
