Dear recipients:
On 23 March 2022, the Commission received correspondence from Daniel Sokolov requesting to add certain information to the record of the above-noted proceeding. That information relates to recent changes to SpaceX’s Starlink services. A copy of the information is enclosed.
Commission staff notes that this information was received after the deadline to submit interventions. However, given that the information is relevant to the issues under consideration in this proceeding, Commission staff is of the view that the enclosed correspondence and information should be treated as a supplemental intervention. A copy will be placed on the public record.
Commission staff is establishing the following further process:
- Pursuant to section 37 of the Telecommunications Act, SpaceX will have until 8 April 2022 to comment on the supplemental intervention. SpaceX is requested to confirm its previous pricing structure across the Far North,Footnote1 how it has changed, and how it may change within the next two years.
- Parties to this proceeding may file comments by 18 April 2022. Comments should be limited in scope to the supplemental intervention, any related comments received from SpaceX, and the impact of the supplemental intervention and SpaceX’s related comments on Northwestel’s application.
- Northwestel may then file reply comments by 25 April 2022. Its comments should be limited in scope to the supplemental intervention, any related comments received from
- SpaceX and other parties to the proceeding, and the impact of the supplemental intervention and related comments on Northwestel’s application.
Commission staff notes that the Commission will determine as a procedural matter whether or not to consider this supplemental intervention, and related comments, in its analysis prior to rendering its decision on the issues raised in Northwestel’s Part 1 application.
Commission staff also notes that as set out in section 39 of the Telecommunications Act and in Broadcasting and Telecom Information Bulletin CRTC 2010-961, Procedures for filing confidential information and requesting its disclosure in Commission proceedings, information may be filed on the record of the proceeding in confidence. A party designating information as confidential must provide a detailed explanation as to why the designated information is confidential and why its disclosure is not in the public interest, including why the specific direct harm that is likely to result from the disclosure outweighs the public interest in disclosure. Furthermore, a party designating information as confidential must either file an abridged version of the document omitting only the information designated as confidential or provide reasons why an abridged version cannot be filed.
A copy of this letter will be placed on the public record of this proceeding.
