RE: Part 1 application filed by Northwestel Inc. dated 6 December 2021, and current Northwestel tariff applications

Dear Minister:

On 6 December 2021, Northwestel submitted an application pursuant to Part 1 of the Canadian Radio-television and Telecommunications Rules of Practice and Procedure, requesting that the Commission waive the requirement for Northwestel to satisfy the price floor test for tariff notices for certain retail residential terrestrial Internet services. Upon posting the application to its website, the Commission set a deadline for interested parties to submit interventions of 4 February 2022, and a deadline for Northwestel’s reply to interventions of 14 February 2022.

On 15 February 2022, Commission staff received correspondence dated 11 February 2022, by way of postal mail from The Honourable Nils Clarke, Minister of Highways and Public Works for the Government of Yukon. The correspondence makes reference to several proceedings to which Northwestel is a party, including: Telecom Notice of Consultation 2020-367, Review of the Commission’s regulatory framework for Northwestel Inc. and the state of telecommunications services in Canada’s North; a Part 1 application submitted by SSi Canada; and the present Part 1 application submitted by Northwestel.

Given the nature of this correspondence, Commission staff is of the view that it should be treated as an intervention and will be placed on the public record of the present Part 1 proceeding initiated by Northwestel. Further, Commission staff is of the view that no further process is required for Northwestel to comment on this intervention, as it does not prejudice the applicant. Nevertheless, given that the intervention was received after the deadline to submit interventions, Commission staff notes that the Commission will determine, as a procedural

matter, whether or not to consider this intervention in its analysis (including whether any further process is required) prior to rendering its decision on the issues raised in Northwestel’s Part 1 application.
A copy of this letter will be placed on the public record of this proceeding.
