RE: Iristel Inc.’s (Iristel) Intervention for Telecom Notice of Consultation CRTC 2020-269-2: Call for Comments – Imposition of Administrative Monetary Penalties (AMPs) on Iristel and TELUS Communications Inc. in relation to the Routing and Termination of Phone Calls to the 867 Area Code in Northern Canada

Dear Jean-François:

On 17 January 2022, Iristel filed an intervention with the Commission regarding Telecom Notice of Consultation CRTC 2020-269-2.  While the Commission considers all interventions before releasing a final decision, Commission staff is issuing this letter to provide Iristel with immediate clarification regarding certain statements in Iristel’s intervention.

Iristel stated in its intervention that there is no opportunity for it to negotiate or enter into an undertaking. In support of these statements, Iristel cited a telephone conversation with Commission staff on 17 December 2021.

Commission staff notes that, as indicated to an Iristel representative during the telephone call related to questions about procedural options available to Iristel, requests made under the General AMPs Regime to enter into an undertaking are currently handled on a case-by-case basis, as the Commission has not designated a person authorized to issue notices of violation or accept an undertaking under subsection 72.004(a) of the Telecommunications Act.  This does not prevent a party from filing a procedural request, asking that the Commission designate a person in a particular case, who would have the authority to issue a notice of violation or enter into an undertaking.

As explained by Commission staff during the telephone conversation, Iristel can make its request to enter into an undertaking by submitting a procedural request as part of the proceeding for Telecom Notice of Consultation CRTC 2020-269-2.
