Re : Your intention to submit an application for mandatory distribution of Inuit TV on the basic digital service
In Broadcasting Notice of Consultation 2022-252, published on 21 September 2022, the Commission announced that it would consider, among other things, an application filed by Nunavut Independent Television Network (NITV) for a broadcasting licence to operate the currently exempt national, Indigenous-language discretionary service Uvagut TV as a licensed service and for mandatory distribution of the service on the digital basic service of broadcasting distribution undertakings across Canada, pursuant to paragraph 9(1)(h) of the Broadcasting Act.
As part of this proceeding, in an intervention dated 7 November 2022, you indicated that Inuit TV Network intended to submit its own application for mandatory distribution on the digital basic service for the service Inuit TV but decided against it as you hoped to negotiate a merger or partnership with NITV.
The Commission has published Broadcasting Notice of Consultation 2022-252-1 announcing the withdrawal of NITV's application from the 10 January 2023 non-appearing hearing. The Commission determined that given the issues raised in the written interventions, it would be more appropriate to consider that application at a future public hearing.
In light of the above, if you intend to submit an application for the distribution of the service Inuit TV on the digital basic service to be considered at the same future public hearing as for NITV, you are encouraged to do so by no later than 27 January 2023.
Please note that in order for this application to be considered by the Commission, you must demonstrate that your programming service meets the specific criteria set out in Criteria for the assessment of applications for mandatory carriage on the basic digital service, Broadcasting Regulatory Policy CRTC 2010-629, 27 August 2010.
If you do not wish to submit such an application, please notify Commission staff in writing by no later than 9 January 2023.
Please note that all information provided, with the exception of information for which confidentiality has been requested and granted, will be placed on the public record for the application once that application is published, will be posted on the Commission's website, and will be made available for public examination.
