The Commission is in receipt of the above-noted application to renew the broadcasting licence for the English-language, commercial radio station, CJMU-FM Bracebridge, ON. Please respond to the questions set out in this letter. The information requested herein should be received by the Commission no later than 14 December 2022 (5 days for response).

Considering the above request, once the application is completed with this additional information the Commission will re-publish the application for additional comments.

Annex 1 - Questions

1. Condition of licence related to over-and-above CCD contributions

In Broadcasting Decision 2016-399, the Commission noted that the licensee committed to make an over-and-above contribution to Canadian content development (CCD) of $10,000 in each broadcast year as of the commencement of operations, for a total contribution of $70,000 over seven consecutive broadcast years.

Commission records indicate that CJMU-FM began operating in August 2018 of broadcast year 2017-2018. Given that the station will have operated through its first 6 consecutive years upon the expiration of the current licence on 31 August 2023, the licensee would be required to contribute the remaining over-and-above CCD contributions in the next licence term.

As set out in Broadcasting Information Bulletin CRTC 2009-251, the Commission generally requires a licensee, in its first year of operation, to make a pro-rated payment, related to its over-and-above CCD contribution requirements in an amount representing the number of months the station was in operation during the broadcast year. Given that CJMU-FM operated for a one-month period in broadcast year 2017-2018, the licensee’s required minimum contribution for that broadcast year represents 1/12 of the total required amount for that year (i.e. $834). The licensee would therefore be required to contribute an amount representing the remaining 11 months of its first incomplete year of operation (i.e. $9,166) in the 2024-2025 broadcast year.

You are reminded that the 2021-2022 broadcast year is considered the fifth year of operations and a contribution of $10,000 was due by 31 August 2022.

You are reminded that the 2022-2023 broadcast year is considered the sixth year of operations and a contribution of $10,000 is due by 31 August 2023.

In light of the above:

To fulfill its commitment set out in Broadcasting Decision 2016-399, in addition to the required basic annual contribution to Canadian content development (CCD) set out in section 15 of the Radio Regulations, 1986, as amended from time to time, the licensee shall make a contribution of $10,000 in the 2023-2024 broadcast year and of $9,166 in the 2024-2025 broadcast year to the promotion and development of Canadian content.

This additional CCD contribution shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives as set out in the Revised Commercial Radio Policy, Broadcasting Regulatory Policy CRTC 2022-332, 7 December 2022.
