In your reply dated 17 November 2022, as part of the non-appearing hearing initiated by Broadcasting Notice of Consultation 2022-252 for the above-noted application, you filed a petition with approximately 6,000 signatures, the details of which are contained in Appendices R3 and R4 of your reply.
We note that on 7 November 2022, you filed an initial petition of approximately 750 signatures as a joint intervention in support of the NATYF Inc. application, for addition to the record of the proceeding. The petition you refer to in your reply dated 17 November 2022 and in Appendices R3 and R4 appears to be a more recent version.
According to subsection 26(1) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure Footnote1 , any interested person may intervene in a proceeding in writing within 30 days after the day on which the application is posted on the Commission’s website, or, if a notice of consultation is published by the Commission on its website, within the time period set out in that notice. For this proceeding, the deadline for interventions was 7 November 2022.
Consequently, Appendices R3 and R4, as well as any references to said appendices and the petition to which they refer in your reply, although they have been placed on the public record, will not be considered in the Commission's deliberations.
However, if you would like them to be considered in the Commission's deliberations, you must make a specific request to that effect by 30 November 2022, after which the Commission will consider your request.
We note that you submitted a procedural request dated 17 November 2022 to file additional documents as part of the record, which were submitted on 21 November 2022. You will be notified at a later date of the Commission’s decision in regard to this request. If your request is approved, the additional information will then be placed on the public record and considered in the examination of your application.
